1. Who we are

These Terms of Service ("Terms") form a binding agreement between you and Kaveh Kaviani Maram ("we", "us", "our"), the operator of the Drivetrain Hub application and website (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.

2. Eligibility & account

You must be of legal age in your jurisdiction (or have authority to bind your organization) to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.

3. The Service

Drivetrain Hub is a vehicle command center that lets you record vehicles, log maintenance and fuel, track GPS trips, generate service reports, and access related premium features. Specific features available to you depend on your subscription plan.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not: (a) use the Service for any unlawful, fraudulent, or harmful purpose; (b) send spam or infringe intellectual property rights; (c) upload malware or attempt to probe, scan, or test the vulnerability of the Service; (d) scrape, reverse engineer, or attempt to circumvent technical limits or security controls; (e) resell or redistribute the Service without written permission.

5. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Kaveh Kaviani Maram and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose under your selected plan. You retain ownership of content you upload (such as vehicle data and photos) and grant us a limited license to host and process it solely to provide the Service to you.

6. Payments, subscriptions & taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing cycles, renewals, taxes, currency conversions, and related mechanics are governed by Paddle's Buyer Terms.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You may cancel at any time via paddle.net or by contacting support; access continues until the end of the current paid period.

8. Service availability

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension & termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay applicable fees, pose a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; you may request an export of your data within 30 days, after which it may be deleted.

10. Liability

To the maximum extent permitted by law, our aggregate liability arising from or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is not permitted.

11. Indemnity

You agree to indemnify and hold harmless Kaveh Kaviani Maram from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Kaveh Kaviani Maram is established, without regard to its conflict of laws rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer law gives you the right to a different forum.
